1.1 These Terms and Conditions apply to all orders placed via the online shop lumevetta.com.

1.2 These GTC apply exclusively to consumers within the meaning of Section 1 (1) No. 2 of the Austrian Consumer Protection Act (KSchG) (natural persons who are not acting in the exercise of a commercial or professional activity).
2.1 The presentation of products in the online shop does not constitute a legally binding offer, but rather an invitation to place an order (invitatio ad offerendum).
2.2 By clicking the "Buy Now" or "Order with obligation to pay" button, you place a binding order for the goods contained in the shopping cart.
2.3 The purchase contract is concluded when we accept your order via an order confirmation sent by email. You will receive this confirmation immediately after completing the order process.
2.4 The language of the contract is German.
3.1 All stated prices are final prices in Euros (EUR) including statutory value-added tax (VAT). Additional shipping costs are shown separately during the ordering process.

3.3 The invoice amount is due at the time of the order confirmation.
3.4 The invoice date corresponds to the order date.
3.5 We retain title to the goods until the purchase price has been paid in full (Retention of Title).
4.1 We deliver within the European Union (EU).
4.2 The delivery time is generally 5–7 business days after receipt of payment. In the event of higher demand, the delivery time may vary. We will inform you by email in this case.
4.3 Shipping Costs
EU standard: 4,90 EUR (free of charge for orders over 40 EUR)
4.4 The risk of shipping passes to you upon handover of the goods to the transport service provider, provided you are a consumer.
4.5 We ship with [FedEx / DPD / DHL / Austrian Post]. You will receive an email with a tracking number once your order has been dispatched.
5.1 As a consumer, you have the right to withdraw from this contract within fourteen days without giving any reason (pursuant to Section 11 of the Austrian Distance Selling Act - FAGG).
5.2 The withdrawal period is 14 days from the day on which you, or a third party named by you, have taken physical possession of the goods.
5.3 To exercise your right of withdrawal, you must inform us (Lume Vetta, info@lumevetta.com) of your decision to withdraw from this contract by means of a clear declaration (preferably by email).
5.4 Exception — Sealed Cosmetic Products
The right of withdrawal expires for sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery (Section 18 (1) No. 5 FAGG).
5.5 In the event of an effective withdrawal, we will refund all payments made by you, including delivery costs (with the exception of any additional costs arising from your choice of a delivery method other than our standard delivery), no later than 14 days from the receipt of your declaration of withdrawal.
5.6 The customer bears the cost of return shipping, provided the goods were delivered properly.
6.1 Statutory Warranty
The statutory warranty period is two years from the handover of the goods (Sections 922 et seq. of the Austrian Civil Code - ABGB in conjunction with the KSchG). This applies to defects that already existed at the time of delivery — regardless of the product category.
6.2 What constitutes a defect (Cosmetics)
A defect in the sense of the statutory warranty exists if the product at the time of delivery:
is damaged or leaking
was delivered incorrectly (wrong product, wrong variant)
is expired (Best Before Date already exceeded upon delivery)
does not correspond to the advertised COSMOS Natural certification
shows obvious production flaws (discoloration, abnormal odor, consistency defects)
6.3 What is not a defect (Cosmetics)
The following circumstances do not constitute a warranty claim:
Individual skin reactions or intolerances based on personal disposition (allergies, sensitivities)
Dislike of the product, scent, or texture
Changes due to improper storage (heat, direct sunlight, moisture)
Normal changes after opening the product within the specified PAO period
Opened products without recognizable production flaws
6.4 PAO Period — Usage Notice
Cosmetic products have a limited shelf life after opening (PAO — Period After Opening), indicated by the symbol of an open cream jar with a month specification on the packaging (e.g., "12M" = 12 months after opening). Please observe this information for optimal product effectiveness.
6.5 Procedure in Case of Defects
In the event of defective, damaged, incorrectly delivered, or expired goods, please contact us immediately:

We will get back to you within 48 hours and cover all incurred costs (return shipping, replacement, or refund) for justified defects.
6.6 Skin Reactions
Should you experience unexpected skin reactions after using a product, stop using it immediately and consult a doctor if necessary. Inform us at info@lumevetta.com — we take all feedback regarding product safety seriously and will forward it to our manufacturer (SIA Nord Beauty, Latvia).
Product Information & Liability
7.1 Our products are cosmetics within the meaning of the EU Cosmetics Regulation (EC) No. 1223/2009. They are not intended to treat, alleviate, or cure diseases.
7.2 Please read the full list of ingredients (INCI) on the product packaging before use. In case of known allergies or intolerances, we recommend testing the product on a small patch of skin.

7.3 Our liability is limited to intent and gross negligence, to the extent permitted by law. Liability for slight negligence is excluded, except in cases of personal injury.

8.1 The collection, processing, and use of your personal data are carried out in accordance with our Privacy Policy, which you can view at lumevetta.com/privacy-policy.
8.2 We process your data exclusively for the execution of your order and — given your corresponding consent — for marketing purposes.
Dispute Resolution & Applicable Law
9.1 Austrian law shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG).
9.2 The place of jurisdiction for consumers is the general place of jurisdiction of the consumer in accordance with Section 14 of the KSchG.

Final Provisions
10.1 Should individual provisions of these terms & conditions be or become legally invalid, the validity of the remaining provisions shall remain unaffected.
10.2 We reserve the right to change these terms & conditions at any time. The version valid at the time of the conclusion of the contract is authoritative.
